Terms and conditions: Art & Rest Retreat Wales
Article 1: Applicability and Definitions
1.1 These terms and conditions apply to participation in the Art & Rest Retreat in Wales (hereinafter referred to as “Retreat”), organised by Marloes de Vries (hereinafter referred to as “the Organisor”). Dutch law applies to these terms and conditions.
1.2 “Organiser” refers to Marloes de Vries/Studio Moes and is registered in the Netherland under Chamber of Commerce number 01157664.
1.3 “Participant” refers to the individual who makes a booking and participates in the Retreat.
1.4 “Agreement” refers to the contract between the Organiser and the Participant regarding the booked Retreat, including these terms and conditions.
1.5 “Retreat” refers to the trip or activity in which the Participant participates.
1.6 “Services” refer to all products and services provided to the Participant by the Organisor and/or third parties engaged by the Organisor, including but not limited to the provision of Retreats, as well as any other tasks performed by the Organisor for the Participant.
1.7 By signing the registration form and/or paying (a portion of) the participation fee (also referred to as “registration fee”) for the Retreat, the Participant agrees to these terms and conditions.
Article 2: Scope of Obligations
2.1 The Agreement entered into with the Organisor constitutes an obligation of effort, not an obligation of result.
2.2 If the Organisor’s ability to properly fulfil their obligations depends on information and/or cooperation from the Participant, the Organisor is released from these obligations if such information/cooperation is not provided in a timely manner.
2.3 If the Organisor engages third parties to fulfil the Agreement, the Organisor is obligated to select these third parties carefully.
2.4 The Organisor will endeavour to provide the Services to the best of their knowledge and ability, in accordance with the requirements of good practice, and as much as possible in accordance with written Agreements.
2.5 Participation in the Retreat programme is voluntary. Participants are free to opt out of the programme.
2.6 Opting out of participation in the programme does not entitle the Participant to a refund of the registration fee or to a replacement session or activity.
Article 3: Payment and Travel Costs
3.1 All prices quoted by the Organisor are per person and stated in Euros.
3.2 By signing the registration form and/or paying (a portion of) the registration fee, the Participant agrees to these terms and conditions.
3.3 All prices quoted by the Organisor exclude the Participant’s travel expenses to the country or location of the Retreat.
3.4 Prices do not include massages during the Retreat, travel insurance, health insurance, cancellation insurance, baggage insurance, or other personal expenses.
3.5 The total amount must be paid within 30 days of registering for the Retreat. For bookings made less than three months before the Retreat, the participation fee must be paid in full immediately. Failure to pay on time entitles the Organisor to cancel the Participant’s reservation.
3.6 Registration is only final after payment of the registration fee or, for registrations less than three months before the Retreat, payment of the full participation fee.
Article 4: Right of Withdrawal
4.1 The Participant has no right to cancel the Agreement within 14 (fourteen) days free of charge and without providing a reason, pursuant to Article 6:230p(e) of the Dutch Civil Code. This exception applies to Services related to leisure activities where the Agreement specifies a particular time or period of fulfilment. This exception applies to this Retreat.
4.2 The Services and Retreat offered by the Organisor are explicitly classified as Agreements related to leisure activities. The Agreement specifies a date or period during which the Services will be provided, namely the date of the Retreat.
4.3 The purchase of the reserved Services and Retreat by the Participant is considered a ticket granting access to the Retreat and/or Services. The accompanying brochure contains a detailed description of the Services, enabling the Participant to make an informed decision based on the information provided.
4.4 To accommodate the Participant, the cancellation policy outlined in Article 5.2 applies.
Article 5: Cancellation by the Participant
5.1 Cancellations must be made via email to hello@marloesdevries.com.
5.2 If the Participant cannot attend the Retreat and wishes to cancel, the following refund policies apply:
a. Up to two months before the Retreat: the Participant receives a 50% refund of the total amount (provided the full amount has been paid).
b. Within two months before the Retreat: no participation fees will be refunded.
5.3 The Participant has up to five (5) days before the Retreat to arrange a replacement Participant. The replacement is subject to prior written approval by the Organisor. If the Organisor approves the replacement, no refund of participation fees will be given. The original Participant and the replacement must handle any financial adjustments privately. An administrative fee of €50 will be charged for the transfer.
Article 6: Cancellation by the Organiser
6.1 The Organisor reserves the right to cancel the Retreat for valid reasons, including but not limited to insufficient Participants or if the Organisor falls ill.
6.2 The minimum number of Participants for the Retreat is fourteen. The Organisor may cancel the Retreat and this Agreement if this number is not met.
6.3 Participants will be promptly informed in case of cancellation.
6.4 In the event of cancellation, Participants are entitled to a full refund of payments made but cannot claim compensation or damages.
6.5 In cases of force majeure, the Organisor may terminate the Agreement without liability for damages. Force majeure includes, but is not limited to, war, natural disasters, political unrest, shortages, strikes, or similar situations.
Article 7: Liability
7.1 The Organisor and third parties engaged by the Organisor are not liable for indirect damages attributable to them.
7.2 Liability for direct damages is only possible in cases of intent or gross negligence by the Organisor or their engaged third parties.
7.3 The Organisor accepts no liability for damages covered by travel, health, or cancellation insurance.
7.4 Participants are responsible for assessing whether they are physically fit to engage in activities included in the Retreat. Physical or mental health concerns must be discussed with a qualified medical professional before the Retreat.
7.5 Complaints must be submitted in writing within 14 days of the Retreat’s conclusion.
7.6 Participation in the Retreat is at the Participant’s own risk. The Organisor is not liable for:
a. Injuries or health issues during the Retreat;
b. Loss, damage, or theft of personal belongings during the Retreat;
c. Missed transportation or additional costs outside the Retreat.
7.7 Participants must arrange suitable travel and cancellation insurance and ensure such policies cover a Retreat of this nature.
Article 8: Medical Disclaimers
8.1 The Retreat is not a substitute for medical or psychological treatment.
8.2 Participants are responsible for disclosing any physical or mental conditions that may affect their participation.
Article 9: House Rules
9.1 Retreat premises are non-smoking. Drug use and excessive alcohol consumption are prohibited.
9.2 Participants are expected to respect fellow Participants, the Organisor, facilitators, and the environment at all times.
9.3 Locations are carefully chosen to provide a safe and comfortable environment. Treat the location with care; any damage will be charged to the responsible party.
9.4 Participants who fail to comply with house rules or instructions may be removed from the Retreat without a refund.
9.5 Video or audio recordings during the Retreat are only allowed with prior consent from the Organisor and Participants.
9.6 The Organisor reserves the right to deny participation to individuals deemed unsuitable for the group dynamic.
